(Eaker: Hannah Fry Burns made an effort to claim her share of her father's estate, but nothing seems to have become of her claim in court. Only the civil action paper was made, but it does give a list of the heirs of Nicholas Fry, Sr.)

Greetings. You are hereby commanded to make known to Elizabeth Whitener, Philip Fry, George Fry, Jacob Fry; Martin and Mary Cotner; John and Susannah Killian; George Ikard m. Barbara Fry; Jacob and Catherine Cotner that they personally appear before the Justice of the next county Court to be held in Lincolnton on the first Monday in January next, then and there to show cause if any they have why the nuncupative will of Nicholas Fry, deceased, should not be set aside and administration granted Hannah Burns or such persons the Court shall think proper pursuant to order of Court. . . . October . . . A.D. 1798. . . .
